“In the ‘Gorry’ case, the Court of Appeal had decided the Government’s rules discriminated unlawfully against families with disabled children because the impact on them is worse than on families with children who can share a bedroom safely. The Court had also ruled that disability benefits were not intended to pay for housing needs and that discretionary housing payments (DHP) did not provide for an adequate level of security.”
